Article 1 — Purpose
These general rental terms and conditions govern the relationship between vivasuresagadir.com (hereinafter “the Lessor”) and any individual making a reservation for accommodation (hereinafter “the Lessee”). Any reservation implies full and unconditional acceptance of these terms and conditions.
Article 2 — Reservation
Reservations are made online via the vivasuresagadir.com website. They are considered a reservation request until written confirmation is received from the Lessor. The Lessor reserves the right to accept or decline any request without having to provide a reason for its decision.
Article 3 — Rates and Payment
- Prices are listed in Moroccan dirhams (MAD).
- Payment is made at the office upon the tenant's arrival, in cash or according to the terms agreed upon at the time of confirmation.
- A cleaning fee is added to the nightly rate, unless otherwise noted.
- No online payment is required to confirm your reservation.
Article 4 — Check-in and Check-out
- Check-in: starting at 3:00 p.m.
- Check-out: by 11:00 a.m.
Any late departure not agreed upon in advance may result in additional charges.
Article 5 — Cancellation
- Any cancellation must be communicated in writing (via email or message) as soon as possible.
- In the event of a cancellation less than 48 hours before arrival, the Landlord reserves the right to charge for one night’s stay as compensation.
- In the event of a no-show (failure to show up without prior notice), the reservation will be automatically canceled without a refund.
Article 6 — Obligations of the Tenant
The Tenant agrees to:
- Occupy the dwelling for personal, not professional, purposes.
- Please ensure that the number of guests matches the number specified at the time of booking.
- Return the property in the same condition as when it was received.
- Do not hold parties or gatherings without prior authorization.
- Please be considerate of your neighbors, especially between 10:00 p.m. and 8:00 a.m.
- No smoking inside the apartment.
Article 7 — Liability and Security Deposit
- The landlord may require a security deposit upon arrival, which will be refunded upon departure after the condition of the property has been inspected.
- Any damage found will be deducted from the security deposit, or billed separately if the cost of the damage exceeds the deposit amount.
- The Lessor assumes no liability for theft, loss, or damage to the Lessee's personal belongings.
Article 8 — Capacity
The accommodation is provided for the number of people specified at the time of booking. Any additional unregistered guests may result in the immediate termination of the contract, without refund.
Article 9 — Animals
Pets are not allowed in the accommodations unless the Landlord has given explicit written permission.
Article 10 — Complaints
Any complaints must be made on-site within 24 hours of arrival. No complaints regarding the condition or amenities of the accommodation made after the stay will be considered.
Article 11 — Governing Law
These terms and conditions are governed by Moroccan law. In the event of a dispute, the parties agree to seek an amicable resolution before resorting to legal action. Failing that, the matter will be brought before the competent courts of Agadir.
